Terms and Conditions

1. Scope

These Terms and Conditions ("Terms") apply to all orders placed through the Bianca Xenia online store in the version valid at the time of the order.

The offer is directed to consumers and businesses located within the European Union, Switzerland, and the United Kingdom.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

3. Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer but rather a non-binding invitation to place an order.

By clicking the "Buy Now" button or any comparable order button, you submit a binding offer to purchase the products contained in your shopping cart.

The purchase contract is concluded only upon our explicit order confirmation by email or upon shipment of the goods.

We reserve the right to refuse orders on a case-by-case basis, particularly in cases of suspected misuse, fraud, or pricing errors.

4. Prices and Payment Terms

All prices are displayed in the currency specified in the online store.

Unless otherwise stated, prices include the applicable statutory value-added tax (VAT).

Shipping costs are displayed separately during the checkout process.

Payment may be made using the payment methods offered in the online store.

We reserve the right to exclude certain payment methods.

The selected payment method will be charged immediately upon completion of the order or in accordance with the terms of the respective payment service provider.

5. Delivery and Shipping

Orders are shipped from Germany.

We currently deliver to countries within the European Union, Switzerland, and the United Kingdom.

Delivery times are indicated on the respective product pages and should be understood as estimated delivery times.

Germany: 1–3 business days
European Union: 5–8 business days
Switzerland: 4–7 business days
United Kingdom: 4–7 business days

Delays caused by force majeure, customs clearance procedures, or other circumstances beyond our control do not give rise to any claim for damages.

For deliveries outside the European Union, additional customs duties, taxes, or fees may apply. These charges are the responsibility of the customer.

6. Shipping Confirmation

Once your order has been handed over to the shipping carrier, you will receive a shipping confirmation by email, including tracking information where available.

7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal where applicable under the relevant laws.

8. Returns

Returns are accepted within the period specified in our Withdrawal Policy.

Returned items must be in their original condition:

• Unworn
• Unwashed
• Undamaged
• With all original tags attached
• In the original packaging where available

Where legally permissible, the customer bears the direct cost of returning the goods.

9. Exclusion of Returns

Certain products may be excluded from return for reasons of health protection or hygiene if the protective seal has been removed after delivery.

This applies in particular to swimwear, underwear, or comparable products if they have been worn or if hygiene seals have been removed.

10. Exchanges

Direct exchanges are not available.

If you wish to receive a different item or size, please place a new order.

11. Refunds

Once the returned goods have been received and inspected, refunds will be processed within 14 days using the original payment method.

We reserve the right to withhold reimbursement until the returned goods have been received or proof of return has been provided.

12. Retention of Title

The goods remain our property until full payment has been received.

13. Warranty

The statutory warranty rights applicable under the relevant law shall apply.

14. Liability

We shall be liable without limitation for damages resulting from intent or gross negligence and for injury to life, body, or health.

In the event of a slightly negligent breach of essential contractual obligations, our liability shall be limited to the foreseeable damage typical for the contract.

Any further liability is excluded to the extent permitted by law.

15. Transfer of Risk

For consumers, the risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods.

For businesses, the risk passes to the purchaser upon transfer of the goods to the shipping carrier.

16. Fraud Prevention

We reserve the right to cancel or reject orders where there is reasonable suspicion of fraud, misuse, or other unlawful activities.

17. Intellectual Property

All content on this website, including but not limited to designs, texts, images, graphics, logos, and trademarks, is protected by copyright and trademark laws.

Any use without our prior written consent is prohibited.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers, mandatory consumer protection provisions of the country in which the consumer has their habitual residence shall remain unaffected.

19. Jurisdiction

To the extent permitted by law, the exclusive place of jurisdiction shall be Bern, Switzerland.

Mandatory statutory jurisdiction provisions applicable to consumers remain unaffected.

20. Severability Clause

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by the applicable statutory provision.

21. Consumer Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
